PURPOSE

To record information about Family Violence List proceedings for use in the administration and scheduling of these proceedings as well as to produce statistics for reporting and measuring responsiveness to and effectiveness of the Specialist Family Violence List.

DESCRIPTION

The Family Violence Case Management List records information about Australian Capital Territory Magistrate’s Court criminal proceedings that relate to offences characterised as “family violence” under Practice Direction 2 of 2009.

DEFINITION OF FAMILY AND DOMESTIC VIOLENCE

The definition of a “family violence” offence is that used in the Protocols established under the Family Violence Intervention Program:
“A family violence offence is an offence that takes place within the context of such a relationship and which is an offence identified in Schedule 1 to the Crimes Act 1900 (repealed) or an offence against section 34 of the Protection Orders Act 2001 [now section 90 of the Domestic Violence and Protection Orders Act 2008].”

Offences are set out in Schedule 1 of the Domestic Violence and Protection Orders Act 2008 Schedule 1 and include: murder, manslaughter, assault, driving offences, threats, forcible confinement, stalking, abduction, kidnapping, sexual assault, destroying or damaging property, arson, trespass on government premises, weapons offences, offensive behaviour and burglary.

Aspects of family and domestic violence captured in the data are:
  • physical abuse;
  • sexual abuse;
  • psychological / emotional abuse;
  • verbal abuse;
  • economic abuse;
  • social abuse;
  • property damage; and
  • harassment and stalking.

COLLECTION METHODOLOGY

It is the Director of Public Prosecution’s (DPP) responsibility to ensure that all charges that relate to family violence offences are appropriately identified as such when the charges are first brought before the court. A family and domestic violence flag is created for all cases identified as family and domestic violence related as they progress through court.

Adults and young people charged in the Australian Capital Territory criminal jurisdiction.

DATA AVAILABILITY / DISSEMINATION

The office of the DPP publishes some data in its annual report. No other agency includes data in annual reports.

Data may be available upon request. Data is used for internal reporting purposes generally unless published in evaluation reports. An evaluation report was last published in 2006. Another evaluation report is expected to be published in late 2011.

Family and domestic violence data not routinely published. Latest evaluation report (2006) is available upon request.
